The Tariff Notices published in the Federal Register by the Department of Homeland Security (DHS) and Customs and Border Protection (CBP), Impose Duties to ‘Address the Situation at the (U.S.A.) Border.’ These emergency declarations are primarily made under the auspices of the International Emergency Economic Powers Act (50 U.S.C. §§ 1701, et seq.) However, this authority is explicitly limited. Under 50 U.S.C. § 1702(b)(3), these powers do not extend to “the importation from any country, or the exportation to any country, whether commercial or otherwise, regardless of format or medium of transmission, of any information or informational materials...” This includes, but is not limited to, numismatic coins, collectible banknotes, and medals.
What This Means for Our Clients: Based on our experience and interpretation of the current regulations, no duties or tariffs presently apply to the items offered in this auction—when properly declared. Attica Auctions along with other auction companies and brokers have successfully cleared shipments, with no tariffs applied.
